These Terms and Conditions (T&C) govern the use of the platform Badiportal.ch (hereinafter “Platform”). The Platform offers swimming pool operators (hereinafter “Providers”) the opportunity to publish information and pictures about their locations. This information is made available to visitors (hereinafter “Users”) free of charge. No sale of tickets or services takes place via the Platform.
A registration of the Provider is required to create location profiles. There is no entitlement to registration. The Provider is obliged to provide the data requested during registration truthfully and completely. By submitting the registration, the Provider makes an offer to conclude a user agreement, which the Platform accepts by activating the account.
The Provider bears sole responsibility for the content uploaded by them (texts, pictures, links, opening hours). The Provider undertakes not to publish any content that violates applicable law, common decency, or the rights of third parties (in particular copyright and trademark rights). Links: When linking to external websites, the Provider is obliged to ensure that the linked content is lawful. The Platform expressly does not adopt this content as its own.
The Provider generally retains the copyright to the content they upload. However, the Provider grants the Platform a simple, irrevocable, temporally and spatially unrestricted right of use to reproduce, distribute and make the content publicly accessible on the website for the purpose of presentation. The Provider guarantees that they possess all necessary rights to the content and that no rights of third parties (e.g. persons depicted on photos) are violated.
The Provider indemnifies the operator of the Platform against all claims of third parties asserted against the Platform due to legal violations caused by the content posted by the Provider (in particular copyright infringements in pictures). This includes the costs of appropriate legal defense.
The Platform assumes no liability for the correctness, completeness, or up-to-dateness of the information provided by the Providers. The Platform is only liable for damages resulting from the use of the Platform in cases of intent or gross negligence. Liability for external links is excluded in accordance with statutory provisions (exemption from liability from the time of knowledge).
The Platform reserves the right to review, edit, block, or delete content without stating reasons, in particular if a violation of these T&C is suspected or if a report of a legal violation is received.
Swiss law applies exclusively. Should a provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected thereby (severability clause).
